Privacy Policy

ArtisticHues (“ArtisticHues”, “we”, “us”, or “our”) is a marketplace for handmade work by independent Indian artists. This Privacy Policy explains what personal data we collect when you use our website, why we collect it, who we share it with, and the choices and rights you have. It is written to align with India’s Digital Personal Data Protection Act, 2023 (the “DPDP Act”).

By creating an account or using ArtisticHues, you agree to the practices described here. If you do not agree, please do not use the platform. This policy should be read together with our Terms of Service.

Data we collect

We collect only the personal data we need to run the marketplace, process orders, and pay makers. Depending on how you use ArtisticHues, this may include:

  • Account information. Your name, email address, and chosen handle when you register, along with your password (stored in hashed form).
  • Maker payout details. If you sell on ArtisticHues, the bank account and related payout information we need to remit your earnings, and any identity or tax details required to make those payments lawfully.
  • Orders and addresses. Your order history, shipping and billing addresses, contact phone number, and order-related communications.
  • Usage and analytics data. Information about how you interact with the site — pages viewed, items browsed, approximate location inferred from your IP address, device and browser type, and similar diagnostic data.
  • Cookies and similar technologies. Small files stored on your device that keep you signed in, remember your cart, and — only where you have consented — help us understand how the site is used. See Cookies & analytics below.

We do not ask for and we request that you do not send us sensitive information beyond what is necessary for the purposes above.

How we use your data

We use personal data to:

  • create and manage your account and keep you signed in;
  • process, fulfil, and deliver your orders, and keep you updated on their status;
  • pay makers for items they sell and maintain our records;
  • provide customer support and respond to your questions and grievances;
  • operate, maintain, secure, and improve the platform, including preventing fraud and abuse;
  • send you service messages about your account or orders, and — only with your consent — newsletters and updates you can unsubscribe from at any time;
  • comply with applicable law and enforce our Terms of Service.

Our legal basis: your consent

Under the DPDP Act, we process your personal data on the basis of the consent you give us when you create an account, place an order, or opt in to communications. Your consent is sought for a specific purpose, and we limit our processing to what is necessary for that purpose.

Where the law permits processing for certain legitimate uses — for example, where you voluntarily provide data for a purpose and have not objected, or where we must act to comply with a legal obligation — we may rely on those provisions. You can withdraw your consent at any time (see Your rights); doing so does not affect the lawfulness of processing carried out before withdrawal, and some features may stop working once consent is withdrawn.

How we share data

We do not sell your personal data. We share it only with the service providers (“Data Processors”) who help us run the marketplace, and only to the extent they need it to perform their service for us under contract. These include:

  • Payment providers who process your payments and remit payouts to makers;
  • Logistics and delivery partners who carry your orders to you (they receive your name, address, and contact number);
  • Email and analytics providers who help us send service messages and understand how the site is used.

When you buy an item, the maker receives the information needed to pack and dispatch your order. We may also disclose data where required by law, by a court, or by a government authority, or to protect the rights, safety, and security of ArtisticHues, our users, and the public.

How long we keep data

We keep personal data only for as long as it is needed for the purpose it was collected, or for as long as the law requires us to retain it — for example, order and payment records that we must keep for tax and accounting purposes. When data is no longer required and we are not legally obliged to retain it, we delete it or anonymise it. If you ask us to erase your account data, we will do so subject to those legal retention obligations.

Your rights under the DPDP Act

As a Data Principal under the DPDP Act, you have the following rights in respect of the personal data we hold about you:

  • Access. Request a summary of the personal data we process about you and how we process it.
  • Correction. Ask us to correct or update data that is inaccurate, incomplete, or out of date.
  • Erasure. Ask us to delete personal data we no longer need, subject to our legal retention obligations.
  • Withdraw consent. Withdraw consent you previously gave, as easily as you gave it.
  • Grievance redressal. Raise a complaint with us about how we handle your data, and have it addressed within the timelines required by law.
  • Nominate. Nominate another individual to exercise your rights in the event of your death or incapacity.

To exercise any of these rights, you can update most details directly in your account settings, or write to our Grievance Officer at support@artistichues.com. We may need to verify your identity before acting on a request. If you are not satisfied with our response, you may escalate the matter to the Data Protection Board of India.

Cookies & analytics

We use cookies and similar technologies for two purposes. Essential cookies keep you signed in, remember your cart, and secure the site; these are necessary for ArtisticHues to function and are always on.

Analytics cookies help us understand how the site is used so we can improve it. We set analytics cookies only with your consent. You can decline or withdraw this consent at any time through your browser settings or any cookie preference control we provide, and the site will continue to work without them.

Children

ArtisticHues is not intended for, and is not directed at, individuals under the age of 18. We do not knowingly create accounts for, or process the personal data of, anyone under 18. If you believe a minor has provided us with personal data, please contact our Grievance Officer and we will take steps to delete it.

How we protect your data

We use reasonable technical and organisational measures to protect personal data against unauthorised access, loss, or misuse, including encryption in transit, hashed passwords, and access controls. No method of transmission or storage is completely secure, but we work to protect your data and to address any incident promptly and as required by law.

Changes to this policy

We may update this Privacy Policy from time to time as our practices or the law change. When we do, we will revise the “Last updated” date at the top of this page, and for significant changes we will give you notice — for example, by email or a notice on the site — before they take effect. Your continued use of ArtisticHues after an update means you accept the revised policy.
